対華二十一ヶ条要求
（日本側要求の原文）
［第一号］ 山東問題の処分に関する条約案
日本国政府及支那国政府は、偏に極東に於ける全局の平和を維持し且両国の間に存する友好善隣の関係を益々鞏固ならしめんことを希望し、ここに左の条款を締結せり。
第一条 支那国政府は、独逸国が山東省に関し条約其他に依り支那国に対して有する一切の権利利益譲与等の処分に付、日本国政府が独逸国政府と協定すべき一切の事項を承認すべきことを約す。
第二条 支那国政府は、山東省内若くは其沿海一帯の地又は島嶼を、何等の名義を以てするに拘わらず、他国に譲与し又は貸与せざるべきことを約す。
第三条 支那国政府は、芝盃又は龍口と膠州湾から済南に至る鉄道とを聯絡すべき鉄道の敷設を日本国に允許許す。
第四条 支那国政府は、成るべく速に外国人の居住及貿易の為自ら進で山東省に於ける主要都市を開くことを約す。其地点は別に協定すべし。
［第二号］ 南満東蒙に於ける日本の地位を明確ならしむる為の条約案
日本国政府及支那国政府は、支那国政府が南満州及東部内蒙古に於ける日本国の優越なる地位を承認するに依り、ここに左の条款を締結せり。
第一条 両締約国は、旅順大連租借期限並南満州及安奉両鉄道各期限を、何れも更に九九カ年づつ延長すべきことを約す。
第二条 日本国臣民は、南満州及東部内蒙古に於て、各種商工業上の建物の建設又は耕作の為必要なる土地の賃借権又は其所有権を取得することを得。
第三条 日本国臣民は、南満州及東部内蒙古に於て、自由に居住往来し各種の商工業及其他の業務にに従事することを得。
第四条 支那国政府は、南満州及東部内蒙古に於ける鉱山の採掘権を日本国臣民に許与す。其採掘すべき鉱山は別に協定すべし。
第五条 支那国政府は、左の事項に関しては予め日本国政府の同意を経べきことを承諾す。
（１）南満州及東内蒙古に於て他国人に鉄道敷設権を与へ、又は鉄道敷設の為に他国人より資金の供給を仰ぐこと
（２）南満州及東部内蒙古に於ける諸税を担保として他国より借款を起こすこと
第六条 支那国政府は、南満州及東部内蒙古に於ける政治財政軍事に関し顧問教官を要する場合には、必ず先づ日本国に協議すべきことを約す。
第七条 支那国政府は本条約締結の日より九九カ年間日本国に吉長鉄道の管理経営を委任す。
［第三号］ 漢冶萍公司に関する取極案
日本国政府及支那国政府は、日本国資本家と漢冶萍公司との間に存する密接なる関係に顧み且両国共通の利益を増進せんが為、左の条款を締結せり。
第一条 両締約国は、将来適当の時機に於て漢冶萍公司を両国の合弁となすこと、並支那国政府は日本国政府の同意なくして同公司に属する一切の権利財産を自ら処分し又は同公司をして処分せしめざることを約す。
第二条 支那国政府は、漢冶萍公司に属する諸鉱山付近に於ける鉱山に付ては同公司の承諾なくしては之が採掘を同公司以外のものに許可せざるべきこと、並其他直接間接同公司に影響を及ぼすべき虞ある措置を執らんとする場合には先づ同公司の同意を経べきことを約す。
［第四号］ 中国の領土保全の為の約定案
日本国政府及支那国政府は、支那国領土保全の目的を確保せんが為、ここに左の条款を締結せり。
支那国政府は、支那国沿岸の港湾及島嶼を他国に譲与し若くは貸与せざるべきことを約す。
［第五号］ 中国政府の顧問として日本人傭聘方勧告、其他の件
一、中央政府に政治財政及軍事顧問として有力なる日本人を傭聘せしむること。
二、支那内地に於ける日本の病院、寺院及学校に対しては、其土地所有権を認むること。
三、従来日支間に警察事故の発生を見ること多く、不快なる論争を醸したることも少からざるに付、此際必要の地方に於ける警察を日支合同とし、又は此等地方に於ける支那警察官庁に多数の日本人を傭聘せしめ、以て一面支那警察機関の刷新確立を図るに資すること。
四、日本より一定の数量（例へば支那政府所要兵器の半数）以上の兵器の供給を仰ぎ、又は支那に日支合弁の兵器廠を設立し日本より技師及材料の供給を仰ぐこと。
五、武昌と九江南昌線とを聯絡する鉄道及南昌杭州間、南昌潮州間鉄道敷設権を日本に許与すること。
六、福建省に於ける鉄道、鉱山、港湾の設備（造船所を含む）に関し外国資本を要する場合には、先づ日本に協議すべきこと。
七、支那における本邦人の布教権を認むること。

GROUP I
The Japanese Government and the Chinese Government,
being desirous to maintain the general peace
in the Far East and to strengthen the relations
of amity and good neighbourhood existing
between the two countries, agree to the following
articles:
第一號
日本國政府及中國政府，互願維持東亞全局之和平，並期將現存兩國友好善鄰之關係益加鞏固，茲以定條款如下：
極東における全面的平和の維持を欲し、両国間の既存の友好及び善隣関係を強化しようとする日本政府、及び中国政府は、次の事項に同意する。
Article 1
The Chinese Government engage to give full
assent to all matters that the Japanese Government
may hereafter agree with the German Government
respecting the disposition of all the rights,
interests and concessions, which, in virtue
of treaties or otherwise, Germany possesses
vis-a-vis China in relation to the province
of Shantung.
第一款 中國政府允諾，日後日本國政府擬向ｺ國政府協定之所有ｺ國關於山東省依據條約，或其他關係，對中國政府享有一切權利、利益讓與等項處分，概行承認。
中国政府は、ドイツ政府と日本政府が今後、条約その他によって同意するかもしれない、ドイツが山東省に関し中国に対して有するすべての権利、利益及び特権の譲渡に関するすべての事項に完全な同意を与えることを約束する。
Article 2
The Chinese Government engage that, within
the province of Shantung or along its coast,
no territory or island will be ceded or leased
to any other Power, under any pretext whatever.
第二款 中國政府允諾，凡山東省内並其沿海一帶土地及各島嶼，無論何項名目，概不讓與或租與別國。
中国政府は、山東省内あるいはその海岸に沿う領土、島をいかなる口実の下でも、他の国に対して割譲あるいは租借されないことを保証する。
Article 3
The Chinese Government agree to Japan's building
a railway connecting Chefoo or Lungkow with
the Kiaochou Tsinanfu Railway.
第三款 中國政府允准，日本國建造由芝罘或龍口接連膠濟路線之鐵路。
中国政府は、日本が芝罘又は竜口と膠州−済南鉄道に接続する鉄道を建設することに同意する。
Article 4
The Chinese Government engage to open of
their own accord, as soon as possible, certain
important cities and towns in the Province
of Shantung for the residence and commerce
of foreigners. The places to be so opened
shall be decided upon in a separate agreement.
第四款 中國政府允諾，為外國人居住貿易起見，從速自開山東省?各主要城市作為商埠；其應開地方?行協定。
中国政府は自ら進んで、できるだけ早く、外国人の居住及び通商のために、山東省内の一定の重要な都市及び町を開くことを約束する。開かれる場所は個別の協定の中で決定されるであろう。
GROUP II
The Japanese Government and the Chinese Government,
in view of the fact that the Chinese Government
has always recognized the predominant position
of Japan in South Manchuria and Eastern Inner
Mongolia, agree to the following articles:
第二號
日本國政府及中國政府，因中國承認日本國在南滿洲及東部?蒙古享有優越地位，茲議定條款如下：
日本政府及び中国政府は中国政府が南満州及び東内モンゴルの優越的地位を以前から常に認識しているという事実を考慮して、次の事項に同意する。
Article 1
The two contracting Parties mutually agree
that the term of the lease of Port Arthur
and Dairen and the term respecting the South
Manchuria Railway and the Antung-Mukden Railway
shall be extended to a further period of
99 years respectively.
第一款 兩訂約國互相約定，將旅順、大連租借期限並南滿洲及安奉兩鐵路期限，均展至九十九年為期。
2つの締約国は、ポートアーサー（旅順）と大連の租借期間、及び南満州鉄道及び安東-奉天鉄道に関する期間がそれぞれさらに99年間延長されるだろうということに相互に合意する。
Article 2
The Japanese subjects shall be permitted
in South Manchuria and Eastern Inner Mongolia
to lease or own land required either for
erecting buildings for various commercial
and industrial uses or for farming.
第二款 日本國臣民在南滿洲及東部内蒙古，為蓋造商工業應用之房廠，或為耕作，可得其需要土地之租借權或所有權。
日本臣民は南満州及び東内モンゴルにおいて、様々な商用及び工業的利用法用建物を組み立てるため、あるいは耕作のために必要な土地を賃借しあるいは所有することを許されるものとする。
Article 3
The Japanese subjects shall have liberty
to enter, reside, and travel in South Manchuria
and Eastern Inner Mongolia, and to carry
on business of various kinds commercial,
industrial, and otherwise.
第三款 日本國臣民得在南滿洲及東部蒙古，任便居住往來，並經營商工業等各項生意。
日本臣民は、南満州及び東内モンゴルに立ち入り、居住し、旅行し、かつ様々な種類の商業、工業その他の事業を営む自由を持つものとする。
Article 4
The Chinese Government grant to the Japanese
subjects the right of mining in South Manchuria
and Eastern Inner Mongolia. As regards the
mines to be worked, they shall be decided
upon in a separate agreement.
第四款 中國政府允將在南滿洲及東部蒙古各礦開採權，許與日本國臣民。至於擬開各礦，?行商訂。
中国政府は、日本臣民に南満州及び東内モンゴルで採掘する権利を与える。経営される鉱山については、個別の協定の中で決定されるであろう。
Article 5
The Chinese Government agree that the consent
of the Japanese Government shall be obtained
in advance:
(1) whenever it is proposed to grant to other
nationals the right of constructing a railway
or to obtain from other nationals the supply
of funds for constructing a railway in South
Manchuria and Eastern Inner Mongolia, and
(2) whenever a loan is to be made with any
other Power, under security of the taxes
of South Manchuria and Eastern Inner Mongolia.
第五款 中國政府應允，關於左開各項，先經日本國政府同意而後?理：
一、在南滿洲及東部内蒙古允准他國人建造鐵路，或為建造鐵路向他國借用款項之時。
二、將南滿洲及東部内蒙古各項税課作抵，由他國借款之時。
中国政府は、日本政府の同意が前もって得られるべきであるということに合意する:
(1)南満州及び東内モンゴルにおいて、他の国民に対して鉄道を建設する権利を与えること、あるいは、鉄道の建設のための資金の供給を他の国民から得ることが提案されているとき、
(2)南満州及び東内モンゴルの諸税を担保として他国より借款をなそうとするとき。
Article 6
The Chinese Government engage that whenever
the Chinese Government need the service of
political, financial, or military advisers
or instructors in South Manchuria or in Eastern
Inner Mongolia, Japan shall first be consulted.
第六款 中國政府允諾，如中國政府在南滿洲及東部蒙古聘用政治、財政、軍事各顧問教習，必須先向日本國政府商議。
中国政府は、中国政府が南満州あるいは東内モンゴルにおいて、政治、財政、軍事の顧問業務あるいは教官を必要とするときには常に、まず最初に日本と協議するべきであることを約束する。
Article 7
The Chinese Government agree that the control
and management of the Kirin-Chungchun Railway
shall be handed over to Japan for a term
of 99 years dating from the signing of this
treaty.
第七款 中國政府允將吉長鐵路管理經營事宜，委任日本國政府，其年限自本約畫押之日起，以九十九年為期。
中国政府は、吉林−長春鉄道の管理及び経営が、この条約の署名から起算して99年間日本へ手渡されることに合意する。
GROUP III
The Japanese Government and the Chinese Government,
having regard to the close relations existing
between Japanese capitalists and the Han-Yeh-Ping
Company and desiring to promote the common
interests of the two nations, agree to the
following articles:
第三號
日本國政府及中國政府，顧于日本國資本家與漢冶萍公司現有密切關係，且願攝i兩國共通利益，茲議定條款如左：
日本政府及び中国政府は、日本の資本家と漢冶萍会社の間で既存の密接な関係に注意を払い、2つの国の共通の利益を促進することを望んで、次の事項に同意する。
Article 1
The two Contracting Parties mutually agree
that when the opportune moment arrives the
Han-Yeh-Ping Company shall be made a joint
concern of the two nations, and that, without
the consent of the Japanese Government, the
Chinese Government shall not dispose or permit
the Company to dispose of any right or property
of the Company.
第一款 兩締約國互相約定，俟將來相當機會，將漢冶萍公司作為兩國合弁事業；並允如未經日本國政府之同意，所有屬於該公司一切權利産業，中國政府不得自行處分，亦不得使該公司任意處分。
2つの締約国は、漢冶萍会社に適切な時期が到来したときには2つの国の合弁会社にすること、中国政府は、日本政府の同意なしで、会社を処分せず、あるいは会社が会社のいかなる権利あるいは資産を処分することをゆるさないことに相互に合意する。
Article 2
The Chinese Government engage that, as a
necessary measure for protection of the invested
interests of Japanese capitalists, no mines
in the neighbourhood of those owned by the
Han-Yeh-Ping Company shall be permitted,
without the consent of the said Company,
to be worked by anyone other than the Said
Company; and further that whenever it is
proposed to take any other measure which
may likely affect the interests of the said
Company directly or indirectly, the consent
of the said Company shall first be obtained.
第二款 中國政府允准，所有屬於漢冶萍公司各礦之附近礦山，如未經該公司同意，一概不准該公司以外之人開採；並允此外凡欲措弁無論直接間接對該公司恐有影響之舉，必須先經該公司同意。
中国政府は、日本の資本家の投資した株式の保護のために必要な手段として、前述の会社の同意なしでは、漢冶萍会社所有の鉱山のそばにある、前述の会社以外のものによって運営される鉱山が許されないだろうということを約束する;そしてさらに、前述の会社の利益に直接あるいは間接に影響する恐れがありうるいかなる他の手段が提案される時には常に、前述の会社の同意を得なければならないことを約束する。
GROUP IV
The Japanese Government and the Chinese Government,
with the object of effectively preserving
the territorial integrity of China, agree
to the following article: The Chinese Government
engage not to cede or lease to any other
Power any harbour or bay on or any island
along the coast of China.
第四號
日本政府及中國政府為切實保全中國領土之目的，茲定立專條如下：
中國政府允准所有中國沿岸港灣及島嶼，概不讓與或租與他國。
日本政府及び中国政府は有効に中国の領土を保全する目的で、次の事項に同意する:
中国政府は、いかなる港湾、あるいはいかなる沿岸の島も他国に対し割譲又は租借しない。
GROUP V
第五號
Article 1
The Chinese Central Government to engage
influential Japanese as political, financial,
and military advisers;
第一款 在中國中央政府，須聘用有力之日本人，充為政治財政軍事等各顧問。
中国の中央政府は、政治、経済及び軍事顧問として有力な日本人を雇用する。
Article 2
The Chinese Government to grant the Japanese
hospitals, temples, and schools in the interior
of China the right to own land;
第二款 所有中國地所設日本病院、寺院、學校等，概允其土地所有權。
中国政府は、日本の病院、寺院及び学校が中国国内に土地を所有する権利を認める。
Article 3
In the face of many police disputes which
have hitherto arisen between Japan and China,
causing no little annoyance the police in
localities (in China), where such arrangement:
are necessary, to be placed under joint Japanese
and Chinese administration, or Japanese to
be employed in police office in such localities,
so as to help at the same time the improvement
of the Chinese Police Service;
第三款 向來日中兩國，?起員警案件，以致釀成?車謬??車曷?之事不少，因此須將必要地方之員警，作為日中合弁，或在此等地方之員警署，須聘用多數日本人，以資一面籌畫改良中國員警機關。
日本と中国の間に従来発生した、多くの警察に関する論争を考えた場合、もめ事を起こすことも少なくなかった諸地方(中国の)の警察においては、そのような取決めが必要である。中国の警察庁の改良を支援するためにも、日本中国協同管理下におく、あるいはそのような地方の警察署において日本人を雇用すること。
Article 4
China to obtain from Japan supply of a certain
quantity of arms, or to establish an arsenal
in China under joint Japanese and Chinese
management and to be supplied with experts
and materials from Japan;
第四款 中國向日本採?一定數量之軍械（譬如在中國政府所需軍械之半數以上），或在中國設立中日合?之軍械廠聘用日本技師，並採買日本材料。
中国は一定量の武器の供給を日本から得るか、あるいは日本及び中国の協同管理下に中国の兵器製造所を設立し日本より専門家及び材料を供給すること。
Article 5
In order to help the development of the Nanchang-Kiukiang
Railway, with which Japanese capitalists
are so closely identified, and with due regard
to the negotiations which have been pending
between Japan and China in relation to the
railway question in South China, China to
agree to give to Japan the right of constructing
a railway to connect Wuchang with the Kiukiang-Nanchang
and Hangchou and between Nanchang and Chaochou;
第五款 中國允將接連武昌與九江、南昌路線之鐵路，及南昌、杭州，南昌、潮州各路線鐵路之建造權許與日本國。
南昌-九江鉄道の開発を支援するために、日本の資本家はしっかりと識別されているのだが、どれ、南中国の鉄道問題に関しての日本と中国の間で未決だった交渉に当然考慮を払い、中国は日本に対し九江−南昌線と武昌を接続する鉄道及び、南昌と杭州、南昌と湖州間の鉄道を建設する権利を与えることに同意する。
Article 6
In view of the relations between the Province
of Fukien and Formosa and of the agreement
respecting the non-alienation of that province,
Japan to be consulted first whenever foreign
capital is needed in connection with the
railways, mines, and harbour works (including
dockyards) in the Province of Fukien;
第六款 在福建省内籌弁鐵路，礦山及整頓海口，（船廠在）如需外國資本之時，先向日本國協定。
福建省と台湾との関係及び福建省の非譲渡を尊重する協定を考慮し、外資は福建省における、鉄道、鉱山及び港湾設備(造船所を含む)に関して外資を必要とするときはいつも日本に最初に協議すること。
Article 7
China to grant to Japanese subjects the right
of preaching in China.
第七款 中國允認日本國人在中國有布教之權。
中国は、日本臣民が中国で布教する権利を与えること。
註
※安奉鉄道：満州の安東・奉天間を結ぶ南満州鉄道の支線。
※漢冶萍公司（かんやひょうコンス）：1908年、漢陽鉄廠（製鉄所）・大冶鉄山・萍郷炭鉱の3企業を統合した合併して設立された製鉄・鉱山・石炭株式会社。中国の鉄鋼コンビナート「漢冶萍公司」は、官営八幡製鉄への原材料供給源でもあった。
